Terms of Service

Effective Date: March 25, 2026  |  Last Updated: March 25, 2026

1. Acceptance of Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Customer," "you," or "your") and Dewey's Pizza ("Company," "we," "us," or "our"), the owner and operator of the website located at deweyspizza.click (the "Website"). By accessing, browsing, or otherwise using this Website, by creating an account, by submitting an order, or by clicking any button indicating acceptance, you expressly acknowledge and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using our Website or services on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to such entity.

These Terms apply to all visitors, users, customers, and others who access or use our Website, mobile platforms, or any related services offered by Dewey's Pizza, including online ordering, in-store services, catering requests, and any promotional programs we may offer from time to time.

We reserve the right to update, modify, or replace these Terms at any time. It is your responsibility to review these Terms periodically. Your continued use of the Website following the posting of any changes constitutes acceptance of those changes.

2. Description of Services

Dewey's Pizza is a food service business operating in the United States. Through our Website and other channels, we offer the following products and services:

  • Online Food Ordering: Customers may browse our menu and place orders for pizza, appetizers, beverages, desserts, and other food and drink items available at participating locations.
  • Delivery Services: Where available, we offer delivery of food products to addresses within our designated delivery zones. Delivery availability, fees, and estimated times may vary by location.
  • Carryout/Pickup Orders: Customers may place orders online or by phone for in-store or curbside pickup at designated Dewey's Pizza locations.
  • Catering Services: We may offer catering services for events, parties, and group orders, subject to availability and advance notice requirements.
  • Promotional Programs: From time to time, we may offer special deals, loyalty programs, discount codes, or promotional offers through our Website or affiliated platforms.
  • Informational Content: Our Website provides general information about our menu, locations, business hours, nutritional information (where available), and company history.

We reserve the right to modify, suspend, or discontinue any service or any aspect thereof at any time without prior notice to you. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

Our services are intended for personal, non-commercial use. Any unauthorized commercial use, resale, or redistribution of our products or services is strictly prohibited without our express written consent.

3. Eligibility

To use our Website and services, you must be at least thirteen (13) years of age. If you are under the age of eighteen (18), you must have the consent and supervision of a parent or legal guardian. By using our Website, you represent and warrant that you meet all eligibility requirements. If we discover or believe that you do not meet these requirements, we reserve the right to suspend or terminate your account and refuse service.

Our services are available only to individuals and entities located within the United States. We make no representation that our services are appropriate or available for use outside the United States, and access to our Website from territories where its contents are illegal is prohibited.

4. User Account Registration

To access certain features of our Website, including saving your order history, managing delivery preferences, and participating in loyalty or rewards programs, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information as prompted by any registration forms;
  • Maintain and promptly update your account information to keep it accurate, current, and complete;
  • Maintain the security and confidentiality of your login credentials, including your username and password;
  • Immediately notify us of any unauthorized use of your account or any other breach of security;
  • Accept responsibility for all activities that occur under your account, whether authorized by you or not;
  • Not create an account using a false identity, impersonate another person, or use an account belonging to another person without their permission.

We reserve the right to terminate accounts, refuse service, remove or edit content, or cancel orders at our sole discretion, including if we believe that your conduct violates these Terms or is harmful to other users, us, third parties, or the interests of our business.

5. Ordering, Payment, and Pricing

5.1 Placing Orders

When you place an order through our Website, you are making an offer to purchase the specified products at the stated prices. We reserve the right to accept or decline your order for any reason, including but not limited to product unavailability, errors in product or pricing information, or suspected fraudulent activity. A confirmation email or order receipt does not constitute our formal acceptance of your order.

5.2 Pricing and Taxes

All prices listed on our Website are in United States Dollars (USD) and are subject to change without notice. Prices displayed do not include applicable sales tax, delivery fees, service charges, or tips unless otherwise stated at checkout. You are responsible for paying all applicable taxes, fees, and charges associated with your order.

5.3 Payment Methods

We accept various forms of payment, which may include major credit cards (Visa, Mastercard, American Express, Discover), debit cards, digital wallets, and other payment methods as indicated on our Website at the time of checkout. By submitting payment information, you represent that you are authorized to use the designated payment method and authorize us to charge the total amount of your order, including taxes and applicable fees, to that payment method.

5.4 Payment Security

We use industry-standard encryption and security protocols to protect your payment information. However, we are not responsible for unauthorized access to your payment information resulting from circumstances beyond our reasonable control. We do not store full credit card numbers on our servers; payment processing is handled by reputable third-party payment processors.

5.5 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you believe there was an error in your order, you received incorrect or unsatisfactory items, or you experienced a service issue, please contact us immediately at [email protected]. We will review your concern and, at our sole discretion, may offer a credit, replacement, or refund where appropriate. Promotional credits and gift card values are non-refundable and non-transferable unless required by applicable law.

5.6 Delivery Fees and Minimums

Delivery orders may be subject to minimum order requirements and delivery fees, which will be disclosed at checkout prior to the completion of your order. Delivery zones and availability are determined by the individual location fulfilling your order and are subject to change at any time.

6. User Obligations and Prohibited Activities

By accessing and using our Website and services, you agree to use them only for lawful purposes and in accordance with these Terms. You agree not to engage in any of the following prohibited activities:

  • Using our Website for any purpose that is unlawful, fraudulent, harmful, or otherwise prohibited under applicable federal, state, or local law;
  • Submitting false, misleading, or fraudulent orders, reviews, or account information;
  • Using automated tools, bots, scrapers, crawlers, or similar technologies to access, collect, or copy data from our Website without our express written permission;
  • Attempting to gain unauthorized access to our Website, servers, databases, or any connected systems or networks;
  • Interfering with or disrupting the integrity or performance of our Website, servers, or networks;
  • Uploading or transmitting viruses, malware, or any other malicious code through our Website;
  • Harvesting or collecting email addresses, phone numbers, or other personal information from our Website for commercial purposes;
  • Impersonating any person or entity or falsely claiming an affiliation with any person or entity;
  • Engaging in any conduct that restricts or inhibits any other user from using or enjoying our Website;
  • Using our Website or services for resale or commercial purposes without our prior written consent;
  • Reproducing, duplicating, copying, selling, trading, or exploiting for any commercial purpose any portion of our Website, use of the Website, or access to the Website;
  • Posting, transmitting, or sharing content that is defamatory, obscene, offensive, harassing, or otherwise objectionable;
  • Violating any applicable federal, state, local, or international law or regulation in connection with your use of our Website or services;
  • Circumventing any technological measures we employ to restrict access to portions of our Website;
  • Using any promotional codes, discount coupons, or loyalty rewards in a manner inconsistent with their stated terms or in a fraudulent manner.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these provisions, including reporting such conduct to law enforcement authorities.

7. Intellectual Property Rights

7.1 Ownership

The Website and all of its content, features, and functionality — including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, menu designs, recipes (to the extent protected), trademarks, service marks, trade names, and the overall "look and feel" of the Website — are owned by Dewey's Pizza, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Website solely for your personal, non-commercial use in connection with placing orders or obtaining information about our products and services. This license does not include the right to:

  • Modify or create derivative works based on our Website content;
  • Use any data mining, robots, or similar data gathering and extraction tools;
  • Download or copy account information for the benefit of any third party;
  • Use our trademarks, logos, or branding without our prior written consent;
  • Frame or mirror any part of our Website without our express written consent.

7.3 Trademarks

The name "Dewey's Pizza," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Dewey's Pizza or its affiliates. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Website are the trademarks of their respective owners.

7.4 User-Submitted Content

If you submit reviews, feedback, suggestions, photos, or other content to our Website or social media channels ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not infringe upon the rights of any third party.

8. Food Allergen and Nutritional Information Disclaimer

Dewey's Pizza takes food safety seriously; however, we cannot guarantee that any of our products are free from allergens. Our kitchens handle a wide variety of ingredients, including common allergens such as wheat/gluten, dairy, eggs, nuts, soy, and shellfish. Cross-contamination may occur during preparation.

Nutritional and allergen information provided on our Website is approximate and provided for general informational purposes only. Such information may vary based on ingredient substitutions, preparation methods, and variations between individual locations. If you have a food allergy, intolerance, or other dietary requirement, we strongly encourage you to contact us directly before placing your order and to consult with your healthcare provider. By placing an order, you acknowledge and accept this risk.

9. Third-Party Services and Links

Our Website may contain links to third-party websites, services, or resources, including third-party delivery platforms, payment processors, and social media platforms. These links are provided for your convenience only. We have no control over the content of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. Your use of third-party websites is subject to the terms and conditions and privacy policies of those third parties.

We may use third-party service providers to fulfill orders, process payments, deliver food, or provide other services. We are not responsible for the acts or omissions of such third-party providers, including third-party delivery drivers.

10. Disclaimer of Warranties

We do not warrant that:

  • Our Website will be uninterrupted, timely, secure, or error-free;
  • The results obtained from using our Website will be accurate or reliable;
  • The quality of any products, services, information, or other material purchased or obtained through the Website will meet your expectations;
  • Any errors in our Website will be corrected;
  • Our Website is free from viruses or other harmful components.

Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In such cases, our warranties are limited to the greatest extent permitted by applicable law.

11. Limitation of Liability

In no event shall our total liability to you for all claims arising out of or related to these Terms or your use of our Website and services exceed the greater of: (i) the total amount you paid to Dewey's Pizza in the twelve (12) months preceding the event giving rise to liability, or (ii) one hundred dollars ($100.00 USD).

The limitations of liability set forth in this section are a fundamental element of the basis of the bargain between us and you. We would not be able to provide our Website or services on an economically reasonable basis without these limitations. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dewey's Pizza, its owners, officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your use or misuse of the Website or services;
  • Your User Content or submissions;
  • Your violation of any third-party right, including any intellectual property right, privacy right, or proprietary right;
  • Your violation of any applicable law, rule, or regulation;
  • Any misrepresentation made by you;
  • Your negligence or willful misconduct.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You agree not to settle any such claim without our prior written consent. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

13. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which our principal place of business is located, without regard to its conflict of law provisions.

Our services are subject to applicable federal laws, including the Federal Trade Commission Act ("FTC Act"), which prohibits unfair or deceptive acts or practices in commerce. To the extent applicable, our services may also be subject to state consumer protection laws, including the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) for California residents, as well as other state-specific statutes governing food service businesses and electronic commerce.

To the extent that any dispute is not resolved through the dispute resolution processes set forth herein, you agree that such dispute shall be subject to the exclusive jurisdiction of the federal and state courts located within the United States, and you waive any objections to the exercise of personal jurisdiction over you by such courts and to venue in such courts.

14. Dispute Resolution

14.1 Informal Resolution

We believe most disputes can be resolved without resorting to formal legal proceedings. Before initiating any formal dispute resolution, you agree to first contact us in writing at [email protected] and provide a written description of the dispute, including the nature of your claim, the relief you seek, and any relevant documentation. We agree to attempt to resolve the dispute informally within thirty (30) days of receiving your written notice. If we are unable to resolve the dispute within that period, either party may proceed with formal dispute resolution as set forth below.

14.2 Binding Arbitration

EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT, AND EXCEPT AS OTHERWISE EXPRESSLY PROVIDED IN THESE TERMS, YOU AND DEWEY'S PIZZA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OUR WEBSITE OR SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION. This agreement to arbitrate applies regardless of the legal theory under which any claim is made, including contract, tort, statute, regulation, or any other legal or equitable ground.

Arbitration shall be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association ("AAA") or another mutually agreed-upon arbitration provider. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction thereof.

14.3 Class Action Waiver

YOU AND DEWEY'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties.

14.4 Exceptions

Nothing in this Section 14 shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

15. Term and Termination

These Terms shall remain in full force and effect while you use the Website or any of our services. We reserve the right, in our sole discretion, to:

  • Terminate or suspend your account and access to the Website immediately, without prior notice or liability, for any breach of these Terms;
  • Refuse service to any person or entity, at any time, for any reason;
  • Discontinue, modify, or restrict access to the Website or any portion thereof;
  • Cancel pending orders in the event of suspected fraud, abuse, or violations of these Terms.

Upon termination, your right to use the Website and services will immediately cease. If your account is terminated, we may delete any content or data associated with your account. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at [email protected] and requesting that your account be closed. Termination of your account does not relieve you of any obligations incurred prior to the date of termination.

16. Changes to These Terms

We reserve the right, at our sole discretion, to modify, revise, update, or replace these Terms at any time. When we make changes to these Terms, we will update the "Last Updated" date at the top of this page and may notify you via email, through a notice on the Website, or through other appropriate communication channels.

Your continued use of the Website following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to check this page periodically for changes. If you do not agree to the updated Terms, you must stop using our Website and services.

We may also, at our discretion, seek your affirmative acknowledgment of material changes through a pop-up notification, email confirmation, or similar mechanism. However, the absence of such notification does not negate the effectiveness of any changes made to these Terms.

17. Privacy Policy

Your use of our Website is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Our Privacy Policy describes how we collect, use, store, share, and protect your personal information. We encourage you to review our Privacy Policy carefully. By using our Website, you consent to the practices described in our Privacy Policy.

To the extent you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete personal information, and the right to opt out of the sale or sharing of personal information. Please refer to our Privacy Policy for more information.

18. Accessibility

Dewey's Pizza is committed to ensuring that our Website is accessible to all users, including those with disabilities, in accordance with the Americans with Disabilities Act (ADA) and applicable Web Content Accessibility Guidelines (WCAG). If you experience any difficulty accessing any portion of our Website, please contact us at [email protected] and we will work to provide you with access to the information you need.

19. Electronic Communications

By using our Website and services, you consent to receiving electronic communications from us. These communications may include operational notices relating to your account, order confirmations, updates to policies, and promotional communications (where you have opted in to receive them). You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

If you wish to opt out of promotional communications, you may do so at any time by following the unsubscribe instructions contained in such communications or by contacting us directly. Please note that even after opting out of promotional communications, you may still receive transactional or operational emails relating to your orders or account.

20. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics or public health emergencies, governmental actions or regulations, labor disputes or strikes, supply chain disruptions, power outages, internet service failures, acts of terrorism, or any other event of a similar nature. In the event of a force majeure event, we will use commercially reasonable efforts to resume normal operations as soon as practicable.

21. Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, void, or unenforceable, that provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect. The severed provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the parties agree that the court or arbitrator shall have the authority to modify such provisions accordingly. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.

22. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Dewey's Pizza. No waiver of any breach of any provision of these Terms shall be construed as a waiver of any subsequent breach of the same or any other provision.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Website, constitute the entire agreement between you and Dewey's Pizza concerning your use of the Website and services, and supersede all prior and contemporaneous agreements, representations, warranties, and understandings between you and us with respect to the subject matter hereof. No representation, inducement, promise, or agreement, oral or written, not herein contained, shall be of any force or effect.

24. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

25. Contact Information
